Welcome to 4MED.AI. These Terms of Service ("Terms") govern your access to and use of the 4MED.AI website, applications, and services (collectively, the "Service") operated by 4MED.AI ("we," "us," or "our").

Please read these Terms carefully before using our Service. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

Medical Disclaimer

4MED.AI IS NOT A MEDICAL PROVIDER. The information provided by 4MED.AI is for educational and research purposes only and is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

No Doctor-Patient Relationship: Use of 4MED.AI does not create a doctor-patient relationship. The AI assistant does not provide personalized medical advice, diagnose conditions, prescribe medications, or recommend specific treatments for individual users.

Always Seek Professional Advice: Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of information obtained from 4MED.AI.

Medical Emergencies: If you think you may have a medical emergency, call your doctor, go to the emergency department, or call 911 immediately. 4MED.AI is not designed to handle medical emergencies.

No Warranties on Medical Information: While we strive to provide accurate information from peer-reviewed sources, we make no representations or warranties about the accuracy, completeness, or suitability of the medical information provided. Medical knowledge evolves rapidly, and information may become outdated.

Not for Clinical Decision-Making: 4MED.AI is not intended to be used as a clinical decision support system for patient care. Healthcare professionals should use their own clinical judgment and consult primary sources and clinical guidelines when making patient care decisions.

Nature of Service

4MED.AI is an AI-powered research tool that searches and synthesizes information from medical literature databases including PubMed, ClinicalTrials.gov, and other biomedical sources. The service is designed to:

  • Help researchers find relevant medical literature
  • Provide summaries of published research
  • Support medical education and continuing learning
  • Assist healthcare professionals in literature review
  • Facilitate access to medical knowledge

The service is NOT designed to:

  • Diagnose medical conditions
  • Prescribe or recommend specific treatments for individuals
  • Replace clinical judgment of healthcare providers
  • Provide personalized medical advice for individual patients
  • Serve as a clinical decision support system for patient care
  • Handle medical emergencies

Eligibility and Account Registration

Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

Account Registration

4MED.AI is intended for use by:

  • Individuals seeking general health education (not personalized advice)
  • Research institutions and academic organizations

Healthcare professionals should use their own clinical judgment and not rely solely on information from 4MED.AI when making patient care decisions. The Service is intended to supplement, not replace, professional medical knowledge and clinical training.

Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Use the Service to diagnose or treat patients without proper professional oversight
  • Submit queries containing protected health information (PHI) of others
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers
  • Use automated means to access the Service without our permission
  • Reverse engineer, decompile, or disassemble the Service
  • Copy, modify, or distribute content from the Service without authorization
  • Use the Service to transmit malware or harmful code
  • Impersonate any person or entity or misrepresent your affiliation
  • Use the Service to harass, abuse, or harm others

Limitations of AI Technology

4MED.AI uses artificial intelligence to process and summarize medical information. Users should be aware of the following limitations:

  • Accuracy: AI can make errors in summarization, interpretation, or synthesis of information. AI-generated content should always be verified against primary sources.
  • Currency: The AI may not have access to the most recent publications or may not reflect the latest medical guidelines or research findings.
  • Citations: Citations provided should be independently verified for accuracy. The AI may occasionally generate incorrect or incomplete citations.
  • Context: The AI cannot consider individual patient circumstances, medical history, or other contextual factors that are essential for clinical decisions.
  • Hallucinations: AI systems may occasionally generate plausible-sounding but incorrect information ("hallucinations"). Critical medical information should always be verified.

Intellectual Property Rights

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

  • The Service will function uninterrupted, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • The quality of any information obtained through the Service will meet your expectations
  • Any errors in the Service will be corrected
  • The Service will be available at any particular time or location

Any content downloaded or otherwise obtained through the use of the Service is accessed at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from such download.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 4MED.AI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

THIS INCLUDES, BUT IS NOT LIMITED TO, DAMAGES ARISING FROM:

  • Personal injury or wrongful death
  • Medical decisions made based on information from the Service
  • Errors, mistakes, or inaccuracies of content
  • Unauthorized access to or alteration of your data
  • Statements or conduct of any third party on the Service
  • Any other matter relating to the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Indemnification

You agree to defend, indemnify, and hold harmless 4MED.AI, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of the Service
  • Your violation of any rights of a third party
  • Your violation of any applicable laws or regulations
  • Any content you submit to the Service
  • Any medical decisions made based on information from the Service

Dispute Resolution

Informal Resolution

Before filing a claim against 4MED.AI, you agree to try to resolve the dispute informally by contacting us. We will try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 60 days of submission, you or we may bring a formal proceeding.

Arbitration Agreement

You and 4MED.AI agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of a party's intellectual property rights.

The arbitration will be conducted in accordance with the American Arbitration Association's rules for consumer-related disputes. The arbitration will be conducted in the English language in the state of Delaware.

Class Action Waiver

YOU AND 4MED.AI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Opt-Out

You may opt out of this arbitration agreement by sending written notice to us within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you want to opt out of the arbitration agreement.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

For any disputes not subject to arbitration, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Delaware.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Export Compliance

The Service may be subject to U.S. export control laws and regulations. You agree not to export, re-export, or transfer the Service or any technical data obtained through the Service in violation of applicable export control laws, including U.S. Export Administration Regulations and international sanctions programs.

You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Accessibility (ADA/WCAG)

4MED.AI is committed to ensuring digital accessibility for people with disabilities. We are continually improving the user experience for everyone and applying the relevant accessibility standards.

We aim to conform to Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards. If you experience any difficulty accessing any part of our Service, please contact us and we will work with you to provide the information or service you seek through an alternative communication method that is accessible to you.

Beta Services

We may offer certain features or services on a beta or experimental basis ("Beta Services"). Beta Services are provided "as is" and may contain bugs, errors, or other issues. We make no warranties regarding Beta Services and may discontinue them at any time without notice.

Your use of Beta Services is at your own risk. We are not liable for any harm arising from your use of Beta Services. By using Beta Services, you agree to provide feedback and help us improve the Service.

Survival

The following sections shall survive termination or expiration of these Terms: Medical Disclaimer, Intellectual Property Rights, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, Governing Law, and any other provisions that by their nature should survive termination.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and 4MED.AI concerning the Service and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and 4MED.AI with respect to the Service.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may assign or transfer these Terms, at our sole discretion, without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.

We may provide notices to you via email to the address associated with your account, via posting on the Service, or by other reasonable means. You are responsible for keeping your contact information current.
